Terms and Conditions – Foucan Academy

Where to find information about us and our services

You can find everything you need to know about us, the Foucan Academy (‘FA’) and our services on our website https://www.foucan.com/ (‘the Website’) before you order. We also confirm the key information to you in writing before you order, either by email, or on paper.


Our contract with you

By using our booking system on the Website, you accept and agree to be bound by these Terms and Conditions (‘the Terms’), our Privacy Policy, our Behaviour on Site Policy and such other policies of which we may notify you from time to time, which together constitute the entire agreement between us (‘the Contract’).

The application of the Contract will commence on the date of your booking.

By making a booking, you also confirm that you are the parent or guardian of the child(ren) who are the subject of the booking and have custody and control of them.

How to make a booking

All bookings must be made using the booking form on the Website unless otherwise agreed between the parties. Following receipt of your booking, FA will send you a booking email confirmation. Please ensure that your email address is supplied correctly at the time of your booking otherwise FA will be unable to send the booking email confirmation. If you have not received your booking email confirmation from FFA within 48 hours of making your booking, please contact FA on the contact details for FA as provided on the Website

Information you provide to us

It is vitally important that when you make your booking, you provide us with full and accurate information about the participant(s) for whom you are making the booking. Any information you provide must include full details of any medical requirements, allergies, physical or behavioural matters, special needs and any other additional needs.

If you do not provide us with full and accurate information, then FA reserves the right to exclude the child from the lesson they are attending. If this is deemed necessary, then no refund will be given by FA (We may choose to provide a refund, however this remains our entire discretion).

When you drop off a child at their lesson, you must let FA and the coaches know if there have been any changes in the child’s medical status since you provided information as part of your booking.

Where a child requires regular medication, or emergency response medication such as an epi-pen or inhaler, you will be required to fill in and sign a medical form when you drop off the child at their first lesson.


Booking dates

Booking is termly and our regular classes are offered run in line with school terms: September to December, January to April and April to July. There is no break for half-term. There are standard breaks during the summer school holidays. Please note the specific dates of our classes are displayed on the Website as these may vary from the school you are used to.

Outside of this timetable, holiday sessions, semi-private sessions, private sessions, and birthday parties are booked separately.


Fees and payment

All fees and any offer available to you are detailed on the Website and any promotional material. Where there is a difference between what is stated on the Website and any promotional material, information stated on the Website will prevail. The amount to be paid by you will be detailed at the time of booking.

Fees are payable for the entire term at the time of the booking: the booking is for the participant’s place in a class for every class in that term. Payment must be made in full to secure your booking and the participant’s place in that class. A maximum number of participants is allowed in any one class, therefore, to secure a place the whole term must be booked.

The cost is calculated based on the number of classes (one per week) in that term. A booking beginning part-way through a term will pay for the remaining sessions in that term.

Payments can be made using either a card at the time of booking online.


Communication

How you may contact us

For general questions, queries, pupil progress updates and/or concerns, please send an email to academy@foucan.com. Please use email for routine and non-urgent communication. Our phone number, which is for emergencies and immediate concerns, is: +44 7507 664106.

Please be mindful not to disturb or interrupt coaches during, before or after sessions, as the timetable is busy and their priority should be to deliver the sessions.

How we communicate with you

Communication regarding FA classes, such as cancellation of classes, will be primarily via email. We use a mass email service and this correspondence is often placed in a junk/spam box, so please check this regularly to avoid missing any important correspondence from us and consider adding us to your contact list.

Complaints

A complaint about any matters relating to FA, its policies or administration, should be directed in writing to academy@foucan.com. Any reasonable complaint shall receive fair and proper consideration and answer in a timely manner.


Personal data & promotional material

Protection of personal data

The security and care of our pupils is of paramount importance to us. FA is GDPR compliant. How we use any personal data you give us is set out in our Privacy Policy, which can be found on our website click here.

Media for promotional material

FA and FA coaches will sometimes take photographs or videos of our classes and students to use as promotional material for our business activity, such as for social media, website, events publication and other promotional material. This permission also includes business and personal use by the coaches involved in the FA. Names, age or other details will not be included without explicit consent being sought.

Consent will be sought for this as part of booking our classes. If you opt-in with “Yes” then you give us your consent to using photographs as we describe above. If you do not consent (“opt out”) then we will not use photographs in which your child is identifiable (i.e. where their face is visible) for promotional purposes. You can also opt out at any time by emailing us saying that you wish to opt out [Participant’s Name, Class(es) they are in] from media usage. We will respond by acknowledging your request.

Other parents or participants do not have permission to film or take photographs of other participants. FA will do its best to enforce this policy. Please do not film or take photographs of our classes as they will likely involve participants for whom you do not have permission to film, and it is not a good use of coaches’ time to manage this.


Health & Safety, accident & injury

General

Safety of our participants is important to us, and our coaches will take reasonable precautions to ensure that the activity is done in a safe manner. As with any physical activity, there is a risk of injury inherent to practising freerunning.

FA does not accept liability for personal injury or the death of any person unless directly caused by the proven negligence of FA or its coaches, in this event our liability insurance provides cover of up to £10,000,000 million.

We also remind all participants that safety is their responsibility too. Participants should only do things which they consider to be safe and appropriate for their ability, and take responsibility for equipment being safe to use, and if they have any concerns about safety at any point, they should speak to a coach immediately.

FA coaches hold valid first aid certificates, and we have first aid materials on site. FA coaches are also subject to regular DBS checks.

FA does not accept any responsibility for the practice of Parkour Freerunning outside of FA sessions with coach supervision. We encourage students to train, however it is not our responsibility what students do.

Participants are only the responsibility of FA when participating in a class or otherwise in our care. Participants should not be on any of our equipment, indoors or outdoors, unless it is during their class and under the supervision of a coach. Before and after classes, if a participant is on site, they should be in a designated waiting area.

Parents or carers must be reachable during their child's lesson in case of an emergency. Outside of their class, all children are the sole responsibility of the parent or carer.

Accident reports

In the event of an accident which we deem worthy of reporting, we will complete an accident report form and make reasonable effort to inform you about this.


Personal property

FA does not have or accept any responsibility for any personal property around the venues. Participants and parents/guardians are responsible for anything they bring with them to sessions (including money, mobile phones, keys, watches, computers, etc) and FA is not responsible for any loss, damage, or theft of any such items.

FA accepts no responsibility for lost property or items left behind, though we may endeavour to return them to their owner where possible. Participants and parents/guardians accept that FA may dispose of anything which ends up in their possession.

The carrying and use of mobile telephones, tablets, games consoles and social media by participants are strictly prohibited at FA. If a child is found to be carrying such items FA reserves the right to confiscate it until the end of the lesson.


Wellbeing and Safeguarding

Site access

We want to keep all participants in our sessions and children in our care safe and well, and therefore we request that you assist us in doing so.

Our staff are responsible for site access. Please do not open the main gates into our venues to anybody else and leave it to staff to control access, so that we can ensure that only people who are meant to be on site are on site.

If you collect your children from the site, please ensure you do this in a way which is safe. In particular, we do not want anyone to get hurt running across the road to a car parked on the other side of the site.

Behaviour

FA has a responsibility for ensuring the well-being and safety of all children in our care and have approved procedures for managing behaviour. The company follows a zero-tolerance policy on discrimination, bullying and persistent poor behaviour of any kind, irrespective of any special needs. Participants in our classes should be respectful to other participants and not be nasty, bully, hurt others, in accordance with our Behaviour on Site policy. If you/your child have experienced any behaviour which causes you concern, please speak to us about this (either by emailing us or by speaking to the appropriate coach) so that we can resolve the situation and take necessary action. Please do not try to address this directly with another participant or their parents.

On rare occasions, if a participant behaves in an unacceptable manner, then FA reserves the right to ask you to remove the child(ren) from either for the remainder of the lesson (part exclusion), or for the rest of the period booked (full exclusion). No refund will be made for any remaining lessons booked, and any costs associated with the exclusion will be the parents’ responsibility and you agree that FA has absolute discretion in this matter.

Safeguarding

If something comes to FA’s attention which causes us to have concern for a child’s wellbeing or safety, then we may act upon it. This would usually involve a conversation with the child and may also involve a conversation with the parents, depending on what the child says and the concern at hand. In situations where it is appropriate and we believe it is in the best interests of the child involved, we might contact a relevant national organisation, the national governing body, or a state service and act on their advice.


Classes cancelled or missed

No refunds

Booking is for the participant’s place in the class for every session in the term, whether or not the participant is able to attend or not. This is because there is a maximum number of students allowed in each class, therefore a place for the whole term must be booked.

There is no right to any refund for sessions which the participant is unable to attend for any reason, unless otherwise stated in these Terms.

Cancellation due to events outside our control 

FA is under no obligation to refund lessons missed due to events outside of FA's control. This includes adverse weather conditions resulting in an outdoor class to be cancelled, government policy which prohibits planned and booked classes from taking place, or other force majeure situations. If our supply of a class is cancelled, we will contact you as soon as possible to let you know. FA will not compensate you for such cancellation. We may choose to provide a refund, however this remains our entire discretion.

Cancellation by FA

If FA cancels a class for a reason which is within our control, then we will provide a refund for this. However, it is FA’s discretionary prerogative to decide whether a cancellation counts as being within our control or not.

We can withdraw classes

We can stop providing certain classes. We will endeavour to let you know at least one week in advance and we will refund any sums you’ve paid in advance for classes which won’t be provided.

Cancellation by you

You have a legal right to change your mind about your booking and receive a refund of what you paid for it. This is subject to some conditions, as set out below.

Any bookings paid for by childcare vouchers cannot be refunded due to HMRC regulations relating to childcare vouchers. Instead, refunds will be held as credits in your account for use against future bookings.

If you change your mind about a booking, you must let us know in writing no later than 14 days after the day we confirm we have accepted your order by sending you a booking email confirmation. However, you cannot change your mind once the first lesson of the booking is completed.

If you wish to cancel 14 days after we confirm we have accepted your order and/or after the completion of the first lesson, you will not be entitled to a refund, but FA may (at its discretion) place a credit in your account for use against future bookings.

 We will refund you as soon as possible and within 14 days of you telling us you've changed your mind.

Extended Absence

As a courtesy, please inform us of any known extended absences.

Long-term injury or illness

If a participant experiences an injury or illness which requires them to miss classes for more than a short period of time, we may offer a discretionary refund. For this to be considered, we may ask for evidence to substantiate this. To be clear, this covers incidents which occurred in our classes as well as anything outside our classes.


General

Miscellaneous

If FA says or does anything which goes beyond any of the contractual responsibilities or expectations, this shall be a gesture of goodwill and does not create any obligation or similar on their part. This might include discretionary refunds, replacement classes or some other flexibility.

Nobody else has any rights under this Contract. This Contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this Contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this Contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

Transfer of Contract

We can transfer our Contract with you, so that a different organisation is responsible for supplying the service. We'll tell you in writing if this happens and we'll ensure that the transfer won't affect your rights under the Contract.

You cannot transfer your Contract with us to someone else

Applicable law

These terms are governed by English law.

Jurisdiction

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.
